These Terms & Conditions (“Terms”) govern your purchase and use of services from Sapling Hosting, owned and operated by LiquidWebSpace LTD (England & Wales). By subscribing or using our Services, you agree to these Terms.

1. Definitions
“Account” means the user account through which you access and manage Services. “Client”, “you”, “your” means the person or entity subscribing to or using the Services. “Services” means web hosting, domain registration/transfer/renewal, SSL, email hosting, backups and related offerings. “Plan” means a bundle of Services with specified resources and pricing.
2. Account Registration & Eligibility
- You must be 18+ (or age of majority in your jurisdiction) and able to enter a binding contract.
- Provide true, current, and complete information; keep it updated.
- You are responsible for safeguarding credentials and all activity on your Account. Notify us immediately of any breach.
3. Ordering, Acceptance & Provision of Services
- Orders are offers to purchase Services under these Terms and specific Plan descriptions.
- We may reject or cancel orders (e.g., pricing error, fraud risk, legal non-compliance) and refund where applicable.
- Once accepted, we will make reasonable commercial efforts to provision Services promptly.
4. Service Features, Fair Use & Resource Limits
- Plans include defined resources (disk, bandwidth, CPU, RAM, processes). Excess usage may require upgrade or incur fees.
- We may set fair-use thresholds (e.g., email sends, IOPS, database connections) to protect platform stability.
- We may modify, replace or deprecate features. If a core feature is materially reduced, we will provide notice in advance.
5. Uptime, Maintenance & Support
- We target high availability (e.g., 99.9%) but downtime may occur due to maintenance, updates or incidents.
- Scheduled maintenance will be announced where feasible and performed during low-traffic windows.
- Support is available per your Plan. Response/restore times may vary by severity and Plan level.
6. Tree-Planting & Sustainability Commitments
- For each new Plan signup, and for every month your Plan renews, we commit to plant one mangrove tree in Madagascar via partner organisations.
- “Tree planted” reflects our verified planting activity; trees are not owned by Clients. Reporting is periodic and aggregate.
- Field conditions (weather, logistics, permit changes) may affect timing. We are not liable for delays beyond our control.
7. Pricing, Billing & Renewal
- Fees are payable in advance in GBP (unless stated otherwise) and exclude/include taxes as indicated at checkout.
- Plans renew automatically unless cancelled before the renewal date via the dashboard or by contacting support.
- We may change pricing at renewal; we’ll give at least 30 days’ notice for increases that affect you.
- Non-payment may result in suspension and/or termination after reminders.
8. Refund Policy
- Money-back guarantee: If applicable (see your Plan), new hosting plans may include a limited money-back window; domain registrations, SSL, and third-party pass-through fees are non-refundable.
- No refunds for partially used renewal periods unless required by law or expressly stated.
9. Acceptable Use Policy (AUP)
- You must use Services lawfully and responsibly.
- Please refer to the dedicated Aceptable Use Policy on out site for infomation.
- We may suspend or terminate accounts for AUP breaches without refund.
10. Backups, Data Integrity & Software Updates
- We may perform system-level backups, but you are responsible for backing up your websites, databases and email.
- You must keep your CMS, themes, and plugins updated and secure; third-party software risk is yours.
- We are not liable for loss/corruption arising from your actions, third-party software, or external providers.
11. Security, Data Protection & Privacy
- We implement security controls appropriate to our platform (TLS, firewalls, monitoring, patching).
- We process personal data under UK GDPR/EU GDPR as applicable; see our Privacy Policy for details.
- You are the controller for personal data you collect via your sites; you must provide required notices and safeguards.
12. Intellectual Property & Content
- You own your content; you grant us a limited license to store, transmit and process it to deliver the Services.
- We own our platform, software, documentation and marks; no license is granted except as necessary to use the Services.
- Do not use our brand assets without written permission.
13. Disclaimers & Limitation of Liability
- Services are provided “as is”; we do not warrant uninterrupted or error-free operation.
- We are not liable for indirect, incidental, special, punitive or consequential loss; nor for loss of profits, revenue, data or business.
- Our aggregate liability for any claim is limited to fees paid by you for the affected Service in the 12 months preceding the claim.
- Nothing limits liability where unlawful to do so (e.g., fraud; death/personal injury due to negligence).
14. Suspension, Termination & Effects
- By you: cancel any time via dashboard or support before renewal to stop future charges.
- By us: we may suspend/terminate for material breach, illegal activity, or non-payment.
- Upon termination, access ceases and data may be deleted after a grace period; ensure you export backups beforehand.
- Domains follow registry rules for transfer/expiry; fees may apply.
15. Intellectual Property Infringement Notices
If you believe content hosted via our Services infringes your IP, email contact@saplinghosting.com with: (a) identification of the work; (b) the URL or location of the allegedly infringing material; (c) your contact details; (d) a statement you believe use is unauthorized; and (e) a statement under penalty of perjury that information is accurate and you are authorized to act. We may remove or disable access to challenged content and notify the Client.
16. Changes to Services & Terms
- We may improve, modify, or deprecate features. If we materially reduce a core feature, we’ll provide reasonable notice.
- We may update these Terms; the “Last updated” date will change. Continued use after changes equals acceptance.
17. Force Majeure
We are not liable for delay or failure caused by events beyond reasonable control, including natural disasters, power/internet backbone failures, war, terrorism, civil unrest, embargoes, strikes, pandemics, or acts of government.
18. Governing Law & Jurisdiction
These Terms are governed by the laws of England & Wales. Disputes not resolved amicably shall be subject to the exclusive jurisdiction of the courts of England & Wales.
19. Miscellaneous
- Notices: We may send notices to the email associated with your Account or via the dashboard.
- Assignment: We may assign or transfer our rights/obligations (e.g., merger/sale). You may not assign without consent.
- Severability: If any provision is invalid, the remainder remains in effect.
- Entire Agreement: These Terms, Privacy Policy, AUP, and any Order Form constitute the entire agreement.
- No Waiver: Failure to enforce a provision is not a waiver of that or any other provision.
20. Consumer Information (UK/EU)
- If you are a consumer, statutory rights may apply in addition to these Terms.
- For remote/digital services that begin immediately, cooling-off and refunds may be limited per law.
- You may have rights to access, rectify, erase or port personal data under UK/EU GDPR; see our Privacy Policy.
